Terms of service
Last updated: October 16, 2026
These Terms of Service ("Terms") govern the use of Turbo Notify, including the website, the dashboard, the API, webhooks, event polling and the MCP server (the "Service"). Please read them carefully before using the Service. They should be read together with our Privacy Policy, which explains how we handle personal data.
This English version is a translation. The Portuguese version prevails in case of conflict.
1. Who we are
Turbo Notify is a product of MENUR Tecnologia LTDA, registered under CNPJ 48.215.931/0001-33, State Registration (Inscrição Estadual) 199.786.492 ME, with its registered office at Avenida Tancredo Neves, 2539, Sala 2609, CEO Salvador Shopping, Torre Londres, Caminho das Árvores, Salvador, BA, Brazil ("MENUR", "Turbo Notify", "we", "us").
"You" or "Customer" means the person or company that creates an account and uses the Service. When you use the Service on behalf of a company, you represent that you are authorized to accept these Terms for it, and the company is bound by them.
2. Acceptance and eligibility
By creating an account or using the Service, you confirm that:
- you have read and accept these Terms and the Privacy Policy;
- you are at least 18 years old and legally able to enter into a contract;
- you will use the Service for your professional or business activity, in accordance with the law.
If you do not agree with these Terms, do not use the Service.
3. What Turbo Notify is
Turbo Notify lets your systems send and receive WhatsApp messages through numbers that you link yourself, as a linked device, using the same protocol the WhatsApp app uses. We provide:
- a REST API to send messages and manage numbers, contacts and groups;
- event delivery by polling and, on plans that include webhooks, also by webhook (sent to an address of yours);
- a hosted MCP server, so AI agents can use WhatsApp with your account or your own API key;
- extra numbers, on the plans that include them, which you can use in your own operation or resell to your customers (section 8);
- a dashboard to manage your account, numbers, keys, team, integrations and subscription.
Relationship with WhatsApp and Meta. Turbo Notify is an independent service: it is not the official WhatsApp Business API and has no affiliation with Meta. WhatsApp is a trademark of Meta Platforms, Inc. The Service depends on WhatsApp, which Meta may change, limit or discontinue at any time, without notice and without our involvement. Such changes may affect features of the Service, temporarily or permanently.
We do not provide contacts, lists or phone numbers. You choose who you talk to and what you send.
4. Your account, your keys and your team
- Keep your account information accurate and up to date.
- You are responsible for everything done with your account and your API keys. Treat each key like a password: do not publish it, do not put it in public code, and revoke in the dashboard any key that may have leaked.
- Create keys with only the permissions (scopes) each use needs.
- Members you invite to your organization act on your behalf. You are responsible for what they do in the Service.
- Tell us at support@turbonotify.com if you notice unauthorized use of your account.
5. AI agents and automations
You can connect AI agents, assistants and automation tools to the Service through the MCP server or the API. On the MCP server you can sign in with your account and approve the access. On the MCP server and the API you can also use a key from your account.
- Everything an agent does with your access is your action (a sign-in you approved or a key), under your responsibility, including messages sent, replied to, edited or deleted without human review.
- We recommend a dedicated key for each agent, with the smallest set of permissions it needs, and monitoring what it does.
- Incoming messages are third-party content. Anyone can write to your number trying to manipulate your agent (for example, with instructions hidden in the text). Treat that content as untrusted and do not let it, on its own, trigger sensitive actions such as payments, sharing personal data or bulk messaging.
- The AI provider you choose is contracted by you. What it does with the data your agent sends it is governed by the agreement between you and that provider.
6. Acceptable use and prohibited uses
Use the Service only for lawful purposes, respecting the law, the rights of others and the WhatsApp terms and policies that apply to your account, such as the WhatsApp Terms of Service and the WhatsApp Business Policy.
You may not use the Service to:
- spam: send unsolicited messages, bulk messages, or messages to people who did not agree to be contacted;
- message lists that were bought, scraped or obtained without the people's consent;
- keep writing to people who asked to stop receiving messages or blocked you;
- commit fraud, scams, phishing or impersonation, or otherwise deceive recipients;
- harass, threaten, discriminate, spread hate speech or incite violence;
- send illegal content, including child sexual abuse or exploitation material, which we will report to the competent authorities;
- disclose personal or sensitive data of others without a legal basis;
- infringe copyrights, trademarks or other rights of third parties;
- distribute malware or malicious links;
- try to circumvent sending limits, quotas, security or billing controls, including by creating multiple accounts for that purpose;
- access other customers' data, test for vulnerabilities without our written permission, reverse engineer the Service or deliberately overload it;
- resell access to your account or your keys outside the resale model described in section 8.
We may investigate suspected violations and take the measures in section 16.
7. Sending pace and WhatsApp restricting a number
Every connected number follows WhatsApp's rules, and WhatsApp may restrict, suspend or ban a number at any time, because of reports from recipients, sending patterns or its own decision. WhatsApp may also consider the use of automation or unofficial apps to be against its rules.
- To help protect your numbers, Turbo Notify enforces a minimum pace between sends, which varies by plan. This reduces the risk of a restriction but never eliminates it.
- The risk of a number being restricted is yours. We cannot reverse WhatsApp's decisions and have no obligation to request that a number be unblocked.
- Recovering a restricted number is up to the holder of the phone line.
- A number being restricted by WhatsApp does not entitle you to a refund.
8. Reselling numbers
On the plans that include extra numbers (currently Business and Custom), you may use extra numbers to serve your own customers ("end customers"), charging them whatever you choose. In that case:
- You sell your own service. The end customer is your customer, not ours. You alone are responsible to them for the offer, the price, customer service and support. We have no contractual relationship with your end customers.
- You pay Turbo Notify the price of each extra number shown on the pricing page. There is no commission, volume discount or exclusivity, and reselling does not make you a representative or agent of Turbo Notify.
- You are the controller of your end customers' personal data and of their contacts' data, under the LGPD (Brazil's data protection law). It is up to you to define the legal basis, obtain the necessary authorizations, including from the holder of each number before linking it, and make sure that message recipients agreed to receive messages. Turbo Notify acts as the processor of that data (section 13).
- Before linking an end customer's number, tell them that the service is not the official WhatsApp Business API, has no affiliation with Meta, and that WhatsApp may restrict the number (section 7).
- You must pass on to your end customers usage rules equivalent to these Terms and you answer for how they use the numbers in your account, as if the use were your own.
- You may not present yourself as Turbo Notify or as a representative of MENUR or Meta, nor make promises on our behalf.
- If an end customer breaches these Terms, we may suspend the number involved or, depending on the severity, your account.
- If your account is closed or suspended, its extra numbers stop working. Informing your end customers is your responsibility.
9. Plans, prices and payment
- Plans are monthly: Free, Lone Wolf, Business and Custom. Current limits, features and prices are on the pricing page. The Custom plan is negotiated with our sales team at sales@turbonotify.com.
- Billing is prepaid: each month is charged at the start of the period, before use. An upgrade and a new extra number are made available once the payment is approved. On renewal, the plan keeps working while we try to charge (see "Declined payment").
- Payments are made by card and processed by Stripe. We do not store your full card number.
- Currency: accounts of organizations in Brazil pay in Brazilian reais (BRL). Accounts from other countries pay in US dollars (USD). The currency is set by the organization's country, entered or detected at sign-up, when the subscription is created. Fees charged by your bank or card issuer, such as currency conversion fees, are yours.
- Extra numbers: each extra number is charged when it is added, in proportion to the days left in the current period, and then monthly, together with the plan renewal.
- Declined payment: we try to charge again a few times over one week, and the plan keeps working during that time. If no attempt is approved, sending messages is suspended until the open invoice is paid. You pay it from the dashboard, with the card on file, and sending comes back as soon as no other invoice is open. While the subscription exists, invoices for the following periods keep being issued; to stop paying, cancel the subscription. Billing questions: billing@turbonotify.com.
- Price changes: we will give at least 30 days' notice. The new price applies from the first renewal after that notice period.
10. Plan changes, cancellation and refunds
- Upgrade: takes effect immediately. We charge the difference in proportion to the days left in the current period.
- Downgrade: takes effect at the end of the period already paid. Until then you keep your current plan and can withdraw the change. The change applies only if, on that date, the account is within the new plan's limits (extra numbers and team members); if it is not, the change is dropped, we let you know, and the current plan renews. Remove beforehand whatever exceeds the new limit.
- Cancellation: you can cancel your subscription in the dashboard at any time. The account moves to the Free plan at the end of the period already paid, under the same condition as a downgrade: if on that date it has more extra numbers or members than the Free plan allows, the cancellation is dropped, we let you know, and the current plan renews.
- Removing an extra number: you do not need to disconnect the number first. The removal is scheduled for the end of the period already paid: the number keeps working until then, is no longer charged from the next period, and you can withdraw the removal until then (if the invoice for the next period has already been issued without the number, withdrawing it charges what remains of the period already paid). The exception is a number that was never linked, or was linked recently and barely used: in that case, within limits that prevent abuse, the removal takes effect immediately, the activation charge is refunded automatically and the removal cannot be undone.
- Refunds: monthly fees are not refundable for partial periods. Apart from the extra number case above, refund requests are reviewed by billing@turbonotify.com.
- We may refuse refunds and suspend accounts in case of abuse, fraud or chargeback.
11. Usage limits and message retention
- Each plan has limits per number and per billing cycle, such as messages sent and distinct contacts, plus a minimum pace between sends. Current values are on the pricing page.
- When the message limit is reached, new sends from that number are refused until the next cycle or a plan change. When the contact limit is reached, only sends to contacts that have not yet received a message from that number in the cycle are refused. There are no overage charges.
- Turbo Notify is not an archive of your conversations. Message content is kept for the period of the contracted plan (1 hour by default, up to 72 hours), as described in the Privacy Policy, and then permanently deleted. The message stays on record without its content. Keep in your own system whatever you need to retain.
12. Media and transcription in services you contract
- Images, audio, video and documents are only available when you connect your own S3-compatible storage (Amazon S3, Cloudflare R2 or Supabase Storage). Files go straight to that storage. Without it, the files are not kept: they pass through our servers' memory only to be processed, and are discarded.
- Audio transcription, when you turn it on, uses a transcription provider you contract, with your own key.
- These services are contracted by you and governed by each provider's agreements and policies. You are responsible for their configuration, security, costs, the region where data is kept and how long it is kept there.
13. Personal data and each party's role
- For the data of messages, contacts, groups and numbers that go through the Service at your request, you are the controller and Turbo Notify is the processor, under the LGPD (Law No. 13,709/2018). We process that data only to provide the Service, following your instructions given through the account configuration and use, and we do not use it for other purposes or sell it.
- For your account data (users, billing, support and security records), Turbo Notify is the controller.
- You represent that you have a legal basis for the data you send to the Service and for the messages you send, and you agree to handle requests from the people that data is about. If we receive such a request about data we process for you, we will forward it to you.
- Details are in the Privacy Policy.
14. Intellectual property
- The Service, the software, the Turbo Notify brand, logos, website and documentation belong to MENUR. We grant you a limited, non-exclusive and revocable license to use the Service while your account is active and in good standing, under these Terms, including to resell extra numbers as described in section 8.
- You keep all rights to the content you send and receive. You authorize us to process that content only to provide the Service.
- If you send us suggestions, we may use them to improve the Service, with no obligation to pay for them.
15. Availability, support and changes to the Service
- We work to keep the Service available, but it may be interrupted by maintenance, failures, attacks, third-party problems or changes to WhatsApp. There is no minimum availability commitment unless provided for in a Custom plan agreement.
- Support is provided at support@turbonotify.com and on WhatsApp at +55 11 97311-7056, with no fixed response time. The plans that include priority support are shown on the pricing page.
- We may improve, change or discontinue features. When a change significantly reduces a paid feature, we will give reasonable advance notice.
16. Suspension and termination
- By you: you can cancel your subscription in the dashboard and ask for your account to be closed at support@turbonotify.com. Before that, export through the API whatever you need to keep.
- By us: we may suspend or close an account, a number or a key in case of breach of these Terms, risk to security, to the Service or to others, an order from an authority, fraud, chargeback or non-payment. When possible, we will notify you first. In serious cases, such as spam, fraud or illegal content, we may act immediately.
- After termination, data is handled as described in the Privacy Policy. Payment obligations already due remain payable.
17. Disclaimer
The Service is provided as is and as available. To the extent permitted by law, we do not promise that it will run without interruptions or errors, that it will meet a specific purpose of yours, or that messages will be delivered, read or answered. Delivery depends on WhatsApp, the network, devices and other factors beyond our control.
18. Limitation of liability
To the extent permitted by law:
- we are not liable for lost profits, lost revenue, loss of data you could have kept, indirect damages, or for acts of WhatsApp, Meta, providers you contract or your end customers;
- our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the event that gave rise to the claim.
These limitations do not apply where the law does not allow liability to be limited, such as in cases of willful misconduct.
19. Indemnification
You will indemnify MENUR for losses, damages and reasonable expenses, including attorneys' fees, arising from: (a) use of the Service in breach of these Terms or the law; (b) content you or your agents send; (c) actions of your users, AI agents and end customers; (d) lack of a legal basis or consent for the data and messages you process through the Service.
20. Changes to these Terms
We may update these Terms. Significant changes will be announced by e-mail or in the dashboard at least 30 days in advance, unless the change is required by law or for security reasons. If you do not agree, you can cancel before the change takes effect. Continuing to use the Service after that means you accept the new version.
21. Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the judicial district of Salvador, BA, Brazil, are chosen to settle any dispute, unless the law requires another venue.
22. General provisions
- These Terms, the Privacy Policy and, where applicable, the Custom plan agreement form the entire agreement between the parties. In case of conflict, the Custom plan agreement prevails.
- If any provision is held invalid, the others remain in effect.
- Not enforcing a right does not mean waiving it.
- You may not transfer this account or these Terms to anyone else without our permission. We may transfer them in a corporate reorganization, keeping your terms unchanged.
- Notices about the account are sent to the registered e-mail address.
- These Terms are written in Portuguese. This English version is a translation, and the Portuguese version prevails in case of conflict.
